In March 2009, after a non-jury trial, the Circuit Court for Carroll County issued a declaratory judgment terminating a commercial lease for a warehouse space in Hampstead, Maryland. Source Interlink Distribution, LLC v. BTR Hampstead, LLC. The facts of the case are thoroughly set forth in the Court’s decision, and interesting legal issues were presented and decided. The Court found that the landlord had breached the covenant of quiet enjoyment and wrongfully evicted the tenant by allowing an adjacent tenant to use and occupy the tenant’s space for a prolonged period of time.
